国际保赔协会通函:船舶停靠或经过俄罗斯应尽快报告

The International Group, via individual IG Clubs, have issued a circular under the above title (see full circular below), following the UK Government’s issue of a General Trade Licence on 17th March 2022. The apparent effect of this licence is to require all UK domiciled Clubs and Club Managements to report details of entered vessels calls to Russia and all transits of Russian territorial waters. This imposes a similar reporting requirement on members of UK domiciled clubs and members of non-UK domiciled clubs managed in the UK.

We have been in contact with Club managements and it is apparent that the effect will in fact be far wider. Most Clubs are insisting that all Russian calls and transits are reported because even if the ships are entered in a non-UK Club, branch or subsidiary the shared reinsurance arrangements of the IG Pool mean that risk recycles into London domiciled Clubs and management companies. It is perhaps also worth noting that this advice applies equally to clients with ships insured with IG club backed fixed premium facilities such as Sunderland Fixed (North) and Eagle Ocean Marine (American Club).

 On 17 March 2022 the UK Government published a General Trade Licence in part to clarify earlier amendments to the UK Russia (Sanctions) (EU Exit) Regulations (the “Regulation”). Specifically, the licence addresses the issue as to whether it is lawful under the Regulation for insurers and reinsurers domiciled or operating from the United Kingdom to provide insurance for vessels calling at Russian ports or transiting Russian territorial waters.

2022年3月17日,英国政府公布了一份《一般贸易许可证》,其中澄清了先前对英国《俄罗斯(制裁)(脱欧)条例》(即UK Russia (Sanctions) (EU Exit) Regulations,以下简称“条例”)的修订。具体而言,该许可证解决的问题是,根据《条例》,在英国注册或经营的保险公司和再保险公司为停靠俄罗斯港口或过境俄罗斯领海的船舶提供保险是否符合相关英国法律。

The Licence provides that where the underlying trade is lawful and in accordance with applicable sanctions, UK domiciled Clubs, or UK domiciled subsidiaries, branches and management companies of Clubs, may insure and handle claims arising out of vessels engaged in a trade to and from Russia and / or transiting Russian waters provided that the Club notifies the UK Secretary of State of the name and address at which records are kept in relation to each use of the Licence.该许可证规定,在主体贸易合法且符合相关制裁规定的情况下,在英国注册的协会或协会的英国注册子公司、分支机构和管理公司可以为从事往返俄罗斯贸易和/或过境俄罗斯水域的船舶提供保险和处理索赔,前提是协会需向英国内政大臣(UK Secretary of State)报告有关每次使用许可证所记录/涉及的名称和地址。

The contents of the records that the Club is required to keep are set out in Regulation 76 (General trade licences: records) and include:协会需要保存的记录内容载于《条例》第76条(General trade licences: records),包括:

(a) a description of the act;(b) a description of any goods, technology, services or funds to which the act relates;(c) the date of the act or the dates between which the act took place;(d) the quantity of any goods or funds to which the act relates;(e) [the Insurer’s] name and address;(f) the name and address of any consignee of goods to which the act relates or any recipient of technology, services or funds to which the act relates;(g) in so far as it is known to [the Insurer’s], the name and address of the end-user of the goods, technology, services or funds to which the act relates;(h) if different from [the Insurer’s], the name and address of the supplier of any goods to which the act relates.(a) 对该行为的描述;

This information must be held by the Club until the end of the calendar year in which the information is recorded plus a further period of four years.这些信息必须由协会持有,直到记录信息的日历年年底,再加上四年的时间。

From 17 March 2022, it is now necessary for the owners of vessels that have called in a Russian port or transited Russian territorial waters to notify their club of that call providing as far as possible the details required by Regulation 76. A failure to do so may invalidate the vessel’s P&I insurance cover and / or prevent the Club from covering a claim. Please note that this requirement applies to all entered vessels (including Russian domiciled and flagged vessels) and is not limited to Members domiciled in the UK or operating UK flagged vessels.从2022年3月17日起,停靠俄罗斯港口或经过俄罗斯领海的船舶的船东现在有必要通知其协会该停靠/过境信息,并依《条例》第76条要求尽可能提供详细信息。如若未能满足该要求,可能致使船舶的保赔险失效和/或阻止本协会承保索赔。请注意,此要求适用于所有入会船舶(包括在俄罗斯注册和悬挂俄罗斯旗的船舶),并且不限于在英国注册或运营悬挂英国旗的船舶的会员。

Members are therefore requested to provide within one month of a call to a Russian port or a transit of Russian waters the information requested on the attached spreadsheet together with a copy of the bill(s) of lading for the relevant voyage.因此,会员需在停靠俄罗斯港口或通过俄罗斯水域后一个月内提供所要求的信息以及相关航次的提单副本。

Trade involving Russia is now subject to significant legal restrictions. Members are reminded that cover is not available for trade that breaches applicable sanctions and are advised to conduct thorough due diligence on the parties, cargoes and trade involved before engaging in trade to, through or from Russia.涉及俄罗斯的贸易现在受到重大的法律限制。我们提醒被保险人需注意,协会保险保障不适用于违反制裁规定的贸易;我们建议被保险人,在对俄罗斯进行贸易往来、或经过俄罗斯进行贸易之前,需对所涉及的各方、货物和有关贸易信息进行彻底的尽职调查。
