自开展STCW集中大检查(CIC)以来,上海海事局PSC专班查出了多起以往国际航行船舶不常见的滞留缺陷。
上一期我们介绍了一起由于豁免声明尚未生效导致的配员不足的问题。本期小编将带着各位学习另一个案例:船员未经过高级消防培训承担消防安全职责而导致船舶被滞留的案例。
01基本情况
2022年09月18日,上海海事局PSC专班对B轮开展PSC,经检查发现该轮存在不符合CIC问卷问题Q4(Do seafarers hold relevant certificate of proficiency or documentary evidence)的严重缺陷。
02案例分析
缺陷描述
The 4/E did not hold the COP of advanced fire fighting but he was arranged to carry out the inspection of fire fighting equipment.
产生原因
在对B轮开展PSC检查中,通过船舶消防设备的日常检查保养发现该船有四人负责消防设备检查保养,分别为:大副、大管轮、三副及三管轮。该情况符合船上SMS体系文件的要求。PSCO对该四人的持证情况进行核实,结果发现该船负责日常消防设备维护保养的三管轮没有持有高级消防培训合格证,亦未有证据证明其经过高级消防培训。因此CIC问卷中Q4被检查官认定为不符合,该船被滞留。
PSCO进一步了解到,该船指定该四名船员作为消防设备日常检查的责任人,系公司SMS文件内写明的。该船运行的SMS体系没有按照船舶的实际配员和持证情况进行调整,公司在聘用船员时也未对聘任船员的资质进行有效的适任条件核查,最终导致此问题的发生。

2.2.1 Maintenance, testing and inspections shall be carried out based on the guidelines developed by the Organization* and in a manner having due regard to ensuring the reliability of fire-fighting systems and appliances.

3 Maintenance and testing
3.2 Certain maintenance procedures and inspections may be performed by competent crew members who have completed an advanced fire-fighting training course, while others should be performed by persons specially trained in the maintenance of such systems. The onboard maintenance plan should indicate which parts of the recommended inspections and maintenance are to be completed by trained personnel.

1 Seafarers designated to control fire-fighting operations shall have successfully completed advanced training in techniques for fighting fire, with particular emphasis on organization, tactics and command, in accordance with the provisions of section A-VI/3, paragraphs 1 to 4 of the STCW Code and shall meet the standard of competence specified therein.

6.2 The Company should ensure that each ship is:
.1 manned with qualified, certificated and medically fit seafarers in accordance with national and international requirements; and
.2 appropriately manned in order to encompass all aspects of maintaining safe operations on board.
04缺陷纠正
B轮被滞留后,船舶管理公司指导船舶对该缺陷进行纠正,安排持有高级消防培训合格证的轮机长负责原来由三管轮负责的船舶消防设备的检查工作,并更改了体系文件中的职责分配内容。9月21日,安检员登轮复查合格,对船舶解除滞留。
05案例思考
船舶忽视船员资质的核查
在不需要更换船员的情况下,B轮仅通过修改体系文件就能保证消防设备日常检查的正常开展,足见该船在人员配备上是充足的。但在日常工作布置中,船舶在未对船员持证情况进行核实的情况下盲目按照体系的规定分配工作,忽略了人员权责匹配的问题。
公司招录船员时忽视船员资质核查
公司按照体系为船舶招录船员时,未能完全按照体系文件的要求对聘用船员的资质进行审核,导致被招录船员不符合拟任职岗位的条件。
体系文件审核和复查没有有效落实
本次检查,未列出船舶体系方面的缺陷。但正如前面两点指出的,在体系的具体执行上没有把好关、做到位,导致产生了权责不匹配的严重问题。
安全管理体系是船舶安全和有序运行的制度保证,需要严格执行,避免出现制度和执行两张皮的情况;需要开展审核或复查,查摆制度制定中存在的不足并及时予以修订,既要满足强制性规定的要求,又要结合实际让体系运转流畅。
