BIMCO Maritime Law Academy, Cambridge 8-12 July 2019


BIMCO is introducing a new full week training course. The BIMCO Law Academy covers issues of international maritime law and its relationship with international trade, shipping and marine insurance. It provides an opportunity to acquire and develop legal knowledge and combine it with practical and focused insight into the fundamental principles of shipping and trade law. The BIMCO Law Academy offers the participants a learning resource in constructing legal arguments, which can be applied in professional situations and aims to solve problems and reduce disputes. A core competence is clear and precise communication. Part of the course is therefore to train the skill of building specific legal arguments.
 
PARTICIPANT PROFILE
 
The BIMCO Maritime Law Academy focuses on legal regimes that often apply by choice of parties to international sale and related contracts. The programme has been designed to meet the specific needs of those seeking to expand their experience in maritime law. It has been particularly designed for shipping professionals and those working in banking, ship management or insurance, who need to understand the complex background that legal and contractual relationships create in shipping contracts. At all times, the emphasis will be firmly on commercial practice and the contemporary issues emerging. 
 
LEARNING OBJECTIVES
 
Strengthen your knowledge of how maritime law is used to create a framework for agreements and contracts used in international shipping. 
Understand how your knowledge of international maritime law can be used to solve disputes and argue points of view. 
Become aware of the interests and concerns of other parties to a dispute, and provide practical solutions using this knowledge. 
Be assessed on your knowledge of international maritime law and your understanding of how it fits into international trade. 
Understand how disputes are resolved by building a case on solid legal arguments, which will stand the test of arbitration or a court hearing. 
The BIMCO Summer Academy is residential and takes place at Trinity Hall College at the University of Cambridge, England. All participants will stay at Wing Gardens for the duration of the training. The “boot camp” atmosphere is a key aspect of the learning experience.

SHOULD I ATTEND THE BIMCO SUMMER SHIPPING SCHOOL OR THE BIMCO MARITIME LAW ACADEMY?
 
If you are familiar with the BIMCO Summer Shipping School in Copenhagen, you will recognize the basic layout of the Maritime Law Academy: 5 days in total, residential, i.e. you stay together and work together, in a “boot-camp” atmosphere. Where the Summer Shipping School is focused on providing an overview of the chartering aspects, the Law Academy is focused primarily on the legal issues.  
 
On day five, all participants will take part in a comprehensive simulation exercise. This realistic account of a maritime casualty will be a role play over a full day, and all participants will have individual roles to fill out as owners, charterers, P&I, lawyers, expert witnesses, classification society representatives, hull and machinery insurers and local agents. The simulation is about grounding in a river, with a significant oil spill and damage to both ship and cargo as a result. All parties will work under time pressure to prepare for a fast track arbitration hearing, which will take place in the afternoon. A professional arbitrator will hear arguments and review the evidence. The arbitrator will decide on the merits of the case and by the end of the day, will render a decision and issue an Arbitration Award based solely on the arguments heard, and the evidence submitted.
